Subdivision Regulation Waiver
DescriptionUpon petition, the Town Board may modify certain requirements in the Town's land division regulations (Chapter 480).

Review Procedures
  1. Request. The petitioner submits a written request for a waiver or modification to the town clerk. In the written request for the waiver or modification, the petitioner shall specify the specific provision that the petitioner requests the town to waive or modify, and petitioner's reasons for requesting the same.
  2. Referral to Town Board. Upon receipt of a written request for a waiver or modification, the town clerk shall, within a reasonable time, place the matter on a Town Board agenda for review and action.
  3. Considerations. The Town Board shall make a determination, which shall include consideration, but not necessarily an affirmative finding, of the following factors:
a. Whether the request for a waiver or modification, if granted, would be consistent with the general intent of this chapter and applicable statutory requirements.
b. Whether the request for a waiver or modification, if granted, would adversely affect property owners in the surrounding area.
c. Whether the request for a waiver or modification, if granted, would benefit the petitioner's project in a way that is not inconsistent with the town's interests.
d. Whether petitioner is in full compliance with applicable ordinances and agreements with the town.
e. Whether, instead of granting the request for a waiver or modification, the ordinance itself should be changed to accommodate the kind of situation presented by the petitioner.
f. Any other factor that may be relevant to the matter.

The following are involved in the review of this type of application.

The Town Board is the governing body of the Town of Eagle and is responsible for making decisions on local policies, budgets, and ordinances. The board also reviews certain types of development projects. The board consists of 5 members who are elected to two-year, overlapping terms.

The Plan Commission is a 7-member body established by the Town Board to review certain development projects and act on other matters. Depending on the type of the development proposal, the commission may be advisory to the Town Board or have the authority to make the final decision. Three members also serve on the Town Board; the remaining members are town residents.

Planning staff provides technical support to the Town Board, Plan Commission, Zoning Board of Appeals, developers, neighbors, and other interested parties to facilitate the development review process.
