Description: Because certain land uses have the potential to negatively affect properties in the area they must be reviewed with regard to the layout of such use, design of buildings, and operational characteristics of such use. 

Decision-maker(s): Plan Commission

Basis of decision: The Plan Commission in making its decision needs to consider the following factors:
  1. effects of the project on traffic safety and efficiency and pedestrian circulation, both on-site and off-site;
  2. effects of the project on the natural environment;
  3. effects of the project on surrounding properties, including operational considerations relating to hours or operation and creation of potential nuisances;
  4. compliance with the site design principles and architectural standards enumerated in Division 8 of Article 7;
  5. compliance with other applicable requirements contained in this chapter; and
  6. any other factor that relates to the purposes of this chapter as set forth in § 500.05 of the zoning code or as allowed by state law.

About Reviewers
The following are involved in the review of this type of application.

The Town Board is the governing body of the Town of Eagle and is responsible for making decisions on local policies, budgets, and ordinances. The board also reviews certain types of development projects. The board consists of 5 members who are elected to two-year, overlapping terms.

The Plan Commission is a 7-member body established by the Town Board to review certain development projects and act on other matters. Depending on the type of the development proposal, the commission may be advisory to the Town Board or have the authority to make the final decision. Three members also serve on the Town Board; the remaining members are town residents.

Planning staff provides technical support to the Town Board, Plan Commission, Zoning Board of Appeals, developers, neighbors, and other interested parties to facilitate the development review process.
